II. Data Handling Practices

Applywise Ltd recognises the importance of safeguarding your information and outlines below the types of data we collect and how it's utilised:

Essential Data for Service Provision

To ensure the Lexri AI App functions optimally and to fulfill our contractual commitments to you, we require specific types of information. This essential data includes:

Content Provided by Users: This encompasses all materials you contribute to the App, such as texts typed into chat fields, PDF documents uploaded, and any creations produced through AI within the App. In accordance with our Terms of Service, you retain the right to manage, utilise, and share this content as you see fit. It is important to note, though, that the use of this content is entirely at your discretion and risk, with the responsibility to adhere to relevant laws resting on your shoulders. For the generation and processing of AI-derived content, we collaborate with specialised third parties including OpenAI, L.L.C., and Anthropic, PBC. Additionally, for the "Ask the Web" functionality, we utilise services from Microsoft Corporation and Google LLC to fetch and integrate search results relevant to your queries into the App. Detailed information on the data handling practices of these third parties is available in Section IV.

Contact Details: When you reach out to us through email or our support portal, we gather information such as your name and email address, alongside any additional details you choose to provide. This data is securely stored and managed with the help of our cloud storage solution provided by Amazon Web Services. The primary use of this information is to efficiently respond to your queries, meet your service requests, and communicate with you as needed.

Automatically Collected Data

With your explicit consent, Applywise Ltd utilises advanced third-party technologies for data processing, encompassing advertising and analytics capabilities within our Application. These tools are designed to assess various types of data transmitted by your device, such as identifiers used for advertising purposes. Notably, some of these technologies facilitate profiling— an automated means of processing personal data to discern certain attributes, including but not limited to, your preferences, interests, behaviours, and geographical location. For a comprehensive list of these technologies, please refer to Section IV of this policy. The initiation of such data processing activities is contingent upon your approval of our App's tracking functionalities. Should you decide to retract this consent, guidance on how to do so is available in Section VIII.

In addition to the above, we may also gather and analyse information related to your device and interaction with our App based on our legitimate interests. The scope of this data aligns with the categories previously outlined, primarily consisting of non-personal information that, in isolation, cannot be linked to any individual. This aggregated data is instrumental in the ongoing enhancement of our App, ensuring an optimal user experience.

Detailed Information Collection

Through the Lexri AI App, Applywise Ltd gathers a range of device and user activity data essential for enhancing user experience and app functionality:

Device Information

Upon utilizing our App with your mobile device, we automatically collect data to identify and understand your device's characteristics. This includes:

Device Specifics: Details such as your device's make and model, operating system version, screen specifications, audio settings, battery status, performance metrics like loading times and memory usage are collected.

Connectivity Data: We analyze your internet service details including your mobile network, internet provider, connection type, IP address, session lengths, and browsing speed.

Geolocation Data: With your consent, we gather data regarding your location based on the IP address and device settings, which helps us offer localized content and understand user distribution.

Additional Identifiers: Other unique identifiers set by the App's ecosystem may be collected to facilitate personalized experiences and analytics.

Application Analytics

App Usage Metrics: Information such as the App name, version, and usage statistics are captured for analyzing how our App is engaged with, enabling us to refine and evolve its features.

Cookies and Tracking Technologies

Web Technologies: Cookies, pixels, and scripts are utilized to gather information on how you interact with our App. This data helps in optimizing the App's operation, enhancing marketing efforts, and tailoring content and features to our users' preferences.

Logs and Advertising Data

Interaction Logs: Every access request to the App is logged, noting the times and manner of your interaction with the App, aiding in troubleshooting and improving service quality.

Advertisement Interactions: Data on your interaction with advertisements within our App, including views, clicks, and conversions, are tracked to assess ad performance and relevance.

User Engagement

Activity within the App: We document actions within the App such as tutorial completions, level advancements, transactions, and other significant in-app behaviors to understand user engagement and preferences.

Data shared with external advertising and analytics platforms may extend beyond our direct oversight, limiting our capacity to manage such data. It's important to recognize that several external entities engage in the profiling of personal data, potentially acquiring insights about personal characteristics or device specifics through mechanisms not governed by us. For instances where your Lexri AI user ID intertwines with social media platforms, like Facebook, these platforms might amalgamate your device data with pre-existing demographic profiles. Our role does not encompass the supervision or endorsement of how these external parties handle your data, which is gathered independently of our App. Should you seek clarity or wish to inquire about the management of your data by these entities, we advise consulting them directly (refer to Section IV for more details).

Payment Data Management

Transaction processing within our App, including billing and payment for in-app purchases, is securely managed by our designated e-commerce partner, Apple. This partnership ensures that your payment details are handled with the utmost security, integral to fulfilling our contractual obligations. Applywise Ltd is not privy to, nor does it manipulate, your payment card details directly.

For detailed guidelines on in-app transactions, including purchase conditions and policies, we recommend reviewing the terms provided within the respective app stores.

III. Objectives for Processing Personal Data

At Applywise Ltd, enhancing our App and enriching your user experience is at the heart of our operations. We utilize your data for several critical functions, including:

(a) Facilitating Our Services: We leverage both essential user data and automatically gathered information to deliver the services you request seamlessly.

(b) Optimization and Maintenance: To elevate the performance of our App, we analyze automatically collected data. This helps us grasp user interactions, identify and rectify technical glitches, and ultimately refine the App’s functionality.

(c) Tailored Advertising and Content: We may use your data to offer personalized marketing, showing ads and content aligned with your interests. This approach ensures that the advertisements and content you encounter are more relevant to your preferences.

(d) Engaging with You: Your contact details enable us to reach out to you, whether it’s through newsletters, marketing communications, feedback requests about our App, or updates on our policies and terms. We also rely on this information to provide assistance whenever you contact us.

(e) Safeguarding Our Environment: To maintain a secure, spam-free, and trustworthy App environment, your data plays a crucial role. It assists us in preventing, detecting, and taking action against fraud, security breaches, and any activities that may violate our policies or the law.

Should there be any new reasons for processing your personal data, we pledge to inform you before initiating such processing, incorporating necessary updates into this Privacy Policy.

IV. Disclosure and Sharing of Your Information

Applywise Ltd is committed to protecting your privacy, only sharing your information as explicitly outlined in this Privacy Policy, and in alignment with the UK's data protection regulations.

While we engage with third-party services to enhance our App's functionality, we select partners who demonstrate compliance with rigorous technical and organizational data protection measures. Despite our efforts, the transfer of information to these third parties cannot be entirely secured by us. Thus, Applywise Ltd cannot be held liable for any data breaches or unauthorized access to your personal data that occur beyond our direct control.

Your personal data is not for sale, and we do not rent it out. However, data gathered via cookies, log files, and device identifiers, as well as location data, may be shared with external organizations that facilitate automatic data processing for our App. The management and use of tracking technologies by these third parties fall outside our influence.

Additionally, we may collaborate with third-party advertising partners, sharing data like cookie information to enable them to offer targeted advertising believed to be of interest to you based on your preferences.

Under certain circumstances, we may disclose your personal information for critical reasons, reflecting the public interest or other exigent situations, including:

Compliance with legal obligations;

When necessary to safeguard the rights, safety, and security of Applywise Ltd, our users, or the public, including fraud prevention and responding to government requests;

In the event of a significant business transition, such as a merger, acquisition, or asset sale, we will inform you through a clear notice in our App about the ownership change, how your personal data will be used henceforth, and the choices available to you regarding your information.

V. Cross-Border Data Processing

Applywise Ltd operates globally, offering our App to users worldwide. This global operation necessitates the transfer of data, including personal data processed automatically by us, our third-party service providers involved in data processing, or our advertising partners, across international borders.

For users situated in the European Union or other territories with data protection regulations that differ from those in the United States, it's important to recognize that your data may be moved to countries or jurisdictions with different data protection standards.

Such transfers mean your personal information might be processed in areas where data privacy and security regulations may not offer the same level of protection as in your home country. Our commitment is to ensure that any recipient of your data abroad provides an adequate level of protection for your personal information, in line with applicable data protection laws.

By engaging with our App, you consent to the transfer of your personal data under these circumstances.

Regarding data storage, Applywise Ltd employs the services of reputable hosting providers. We prioritize your privacy, opting to encrypt personal data whenever feasible before it's transmitted for storage. Rest assured, we partner exclusively with hosting services that meet our stringent standards for security and reliability.

VI. Retention of Your Personal Data

Applywise Ltd is dedicated to handling your personal information with care and legality, storing it only for the duration necessary to provide the App's services effectively and to fulfill our legal responsibilities. Should you decide you no longer wish for us to hold or use your data, you have the right to request the deletion of your personal information and the termination of your account with us.

It's important to note, though, that certain categories of your data may be retained for a specific period even after such a request. This retention period will not exceed what is required and is primarily to ensure compliance with legal obligations (such as those related to taxation, accounting, and auditing), as well as to uphold system security, data recovery protocols, prevent fraudulent activities, and protect against other potential threats.

VII. Your Data Protection Rights

Under the data protection laws applicable in the UK, you are afforded specific rights regarding the personal data we hold about you. Here is how you can exercise these rights:

Access to Your Data: You are entitled to request copies of the personal information we hold about you.

Updating Your Information: If it's not possible for you to alter your information directly through your account, you have the right to request modifications, corrections, or updates to your personal data.

Deletion of Your Data: While we typically retain your personal data for the duration of your account's existence or as necessary to deliver our services, you may request the deletion of your data under certain conditions.

Restriction on Data Use: In specific instances, you may have the right to restrict how we use your personal data.

Insight into Data Sharing: You possess the right to be informed about the sharing of your data with third parties. For comprehensive details, refer to Section IV of this Privacy Policy. Should you have additional queries regarding data sharing, please feel free to reach out to us.

Filing a Complaint: If you believe the processing of your personal data violates the General Data Protection Regulation (GDPR), you have the right to lodge a complaint with the relevant regulatory body.

To invoke any of these rights, please utilize our contact form. Note that these rights are applicable only to the data that we directly access and manage.

Regarding automated data processing, should you object to this processing under certain conditions, particularly for direct marketing purposes, you are encouraged to contact the respective third-party services mentioned in Section IV of this Policy. Many of these services offer detailed guidance on their privacy practices and provide mechanisms to object to data processing directly through their platforms.

VIII. Managing Your Preferences

Opting Out of Marketing and Tracking

You have control over your data tracking preferences, including opting out of targeted advertising based on your interests. To adjust these settings:

iOS Device Tracking: Navigate to Settings > Privacy & Security > Tracking on your iOS device to toggle tracking permissions for individual apps. To prevent apps from requesting tracking permissions or accessing your device's Advertising Identifier, disable the “Allow Apps to Request to Track” option. Turning off this setting will effectively opt you out of app-based tracking activities. For disabling Apple’s personalized advertising, switch off “Personalized Ads” under Settings > Privacy & Security > Apple Advertising. Further guidance is available at Apple's support page.

Ad Choices: For broader opt-out options across various platforms, visit Your Ad Choices.

It's important to note that opting out of interest-based advertising doesn’t remove all advertisements. You'll still see contextual ads that are not based on personal data, such as those related to the content of the digital products you use.

Opting Out of Location Data Use

To restrict the use of your precise location data by third-party service providers:

iOS Location Services: For iOS 11 or later, you can turn off Location Services for specific apps. Go to Settings > Privacy > Location Services, select the relevant app, and choose “Never” for “Share My Location”. Additional details can be found on Apple's support site.

By adjusting these settings, you can manage how your information is used and shared, aligning with your privacy preferences.
